NOTE TO CUSTOMER

Please read these Hire Conditions carefully. They contain terms that affect your legal rights, including that: You are fully responsible for loss, theft, or damage to the equipment for the entire hire period. Transportation of the equipment (including using our trailer) is entirely at your own risk. You may be liable for third-party damage or injury caused by you or the equipment during the hire period. No damage waiver, theft waiver, or insurance cover is provided by Sandbox Mini Excavations PTY LTD ( Sandbox Machine Hire therefore, you are to ensure you have your own insurance for any public liability. By signing, you acknowledge you understand and agree to these terms.

 HIRE TERMS

Sandbox Mini Excavations pty ltd ( Sandbox machine hire)  agrees to hire the Equipment to the Customer for the Hire Period on these terms

The Hire Schedule forms part of this Contract. 

We may decline hire to any person for any reason.

CUSTOMER RESPONSIBILITIES

The Customer must Collect the Equipment or arrange transport at own risk

Ensure the Equipment is suitable for their intended purpose before hire commences. 

Operate the Equipment safely, lawfully, and in accordance with manufacturer instructions.

Ensure operators hold the required licences/competency.

Perform daily maintenance (check fluids, grease points, clean tracks, etc.).

Return the Equipment clean and in the same condition as received (excluding fair wear and tear). $90hr rate for the cleaning of the product. 

Report any accident, damage, breakdown, or theft immediately.

Be liable for all costs of repair, replacement, or recovery of the Equipment. 

Secure the Equipment and trailer when unattended.

Keep the Equipment within Victoria unless we approve otherwise in writing. 

Have watched the video’s on the www.sandboxmachinehire.com.au (how to videos) website on the operations of the equipment of unloading, Loading, basic operations and how to travel downhill and up hill, by signing this agreement, you acknowledge you have watched and understand the operations and deem yourself confident in the use of operations of the machine and take all responsible actions to be safe and responsible and take all responsibility of the use of the machine that may cause injury or death or destruction and cannot deem sandbox mini excavations pty ltd reliable for your actions. 

PROHIBITED USE

The Customer must NOT

Sub-hire, lend, or lease the Equipment to others. 

Use the Equipment for illegal purposes.

Exceed the rated capacity of the Equipment.

Use the Equipment in saltwater, corrosive, or hazardous environments. 

Alter, tamper with, or repair the Equipment without written consent.

TRANSPORTATION WAIVER

If the Customer collects the Equipment using our trailer or their own, transportation is entirely at the Customer’s risk.

Sandbox Mini Excavations pty ltd (sandbox machine hire) is not liable for: Damage to the Equipment during loading, transport, or unloading; Damage to the Customer’s vehicle or property; Injury to persons during transport; Road traffic fines, infringements, or accidents.

The Customer takes full responsibility for ensuring legal towing capacity, correct securing, and compliance with road laws.

Sandbox mini excavations pty ltd ( Sandbox machine hire) is not liable for any damage, injury or death from and objects that may be loose during transportation or that is tied down and the person hiring the equipment does a risk assessment and check to make sure the load is secured correctly.

PAYMENT TERMS

Hire Charges and Bond are payable before hire commences unless agreed otherwise in writing. 

Late returns will be charged at the daily hire rate until returned. 

Additional charges apply for: Excessive cleaning $90 hr; Missing or damaged parts; fuel top-up if not returned full, $90hr plus $3 a litre; Recovery of Equipment from site if not returned $90hr plus $1.30 per km. All amounts payable under this Contract are recoverable as a debt.

The machines at 1 Day hire allow a total of 8 hours per day, any hour after the allocated 8 hours is an additional $35+gst per hour added to the machine 

LOSS, DAMAGE, AND THEFT

The Customer is fully liable for: Loss, theft, or destruction of the Equipment; Any damage (regardless of cause) during the Hire Period; Damage to third-party property caused by the Equipment or its operation. The Customer must cover repair or replacement costs at the current market value, plus transport and downtime costs. 

No insurance is provided by Sandbox Mini Excavations pty ltd ( sandbox machine hire ) – the Customer is encouraged to arrange their own insurance.
 

PPSA 

Sandbox Mini Excavations retains ownership of the Equipment at all times.

The Customer grants us a security interest in the Equipment under the PPSA. 

We may register this interest and the Customer will do all things necessary to enable registration. 

The customer will allow access to the machine at all times for inspection or for the possession/recovery of the machine at any time.

DEFAULT & TERMINATION

We may terminate this Contract and recover the Equipment if: The Customer breaches any term of this Contract; Payment is not made when due; The Customer becomes bankrupt or insolvent.

On termination, all unpaid hire charges and costs are immediately due.

PRIVACY

We collect personal information for the purpose of administering this Contract.

We comply with the Australian Privacy Principles.
